Implementation of DMEPOS Final Rule Delayed
The effective date for the final rule “Medicare Program; Competitive Acquisition of Certain Durable Medical Equipment, Prosthetic, Orthotics and Supplies (DMEPOS) by Certain Provisions of the Medicare Improvements for Patients and Providers Act of 2008 (MIPPA)” has been delayed another 60 days.
The effective date of the Jan. 16 interim final rule with comment period, first set for Feb. 17, is now April 18. The necessary extension gives Department of Health and Human Services (HHS) officials time to further review certain MIPPA provisions that allows the Centers for Medicare & Medicaid Services (CMS) to delay Round 1 of the competitive bidding program implementation, requires CMS to conduct a second Round 1 competition this year, and mandates particular changes for both the Round 1 rebid and subsequent rounds of the program.
Public comment on the effective date’s delay is being accepted until March 23. Commenting instructions are included in the action.
