The Centers for Medicare & Medicaid Services (CMS) released new regulations on May 11 which affect physicians. “Medicare Program; Payment Policies Under the Physician Fee Schedule and Other Revisions to Part B for CY 2010; Corrections; Final Rule” corrects several technical and typographical errors in the final rule with comment period (74 FR 61738) that appeared in the Nov. 25, 2009 Federal Register and also in the Dec. 10, 2009 corrections notice (74 FR 65449).
Some of the corrections are due to recent legislation, such as the Department of Defense Appropriations Act, which provided a two-month zero percent update to the 2010 Medicare Physician Fee Schedule (MPFS) through Feb. 28, the Temporary Extension Act of 2010, which further extended the zero percent update to the MPFS through March 31, and most recently, the Continuing Extension Act of 2010, which extended the zero percent update to the MPFS through May 31.
Also in the final rule, CMS corrects the conversion factor, which was necessary after making corrections to the practice expense (PE) and malpractice (MP) relative value units (RVUs). PE RVUs for 27 CPT® codes also are corrected due to technical errors.
Corrections in this final rule are effective Jan. 1.
