can you bill for an H&P if a full E&M is rendered?

This is a question for all the coders out there. One of the physicians in the practice I work for is doing a full E&M on all of his H&P patients prior to surgery. This is not just bringing the patient in to fill out paperwork for surgery. He is reviewing lab work and doing a full workup on the patient as required by the hosptial. He is wondering if can he bill this out as and E&M even though the decision for surgery took place prior to this visit. Currnetly these visits are being no-charged as an H&P for surgery.
