If a physician (other than the ER physician) does a consult in the ER and they cannot bill a consult (Insurance follows CMS guidelines), can they bill using the Emergency Department codes? Or would this visit have to be coded as new/established patient?

We bill ER codes and we follow CMS. We convert to the New/Est is when the patient is in OBS status. Hope the helps :)
