Wiki ER physician admitting to himself

I have a question. I work for a critical access hospital (CAH) and I keep seeing that a particular ER physician keeps admitting to himself with the excuse that there is no other physician to admit to. Is this legal?

This happens at our facility also. What we do is not charge an ED professional level, and instead charge the H&P admit CPT for that doctor
