If a PA dictates an H&P or a consultation in the hospital, the attending physician is the name on the report - can we bill under the attending physician or do we bill under the PA- difference of opinion in my office - please advise.

All services performed in a facility must be billed under the ID of the provider who performed those services, at least under CMS guidelines. 'Incident to' rules are limited to the office and can't be used for professional billing in a hospital. The only exception is for a 'shared visit', when the PA and MD both perform and document a 'substantive' portion of the E&M service, in which case it can be billed under the MD credentials.
