We have a provider that states he has seen patients in an office of the ALF, but he does not rent the space. I am trying to locate something in writing that states he cannot do this, or at least some clarification on laws concerning this.

You'll want to look into the Stark law and the Anti-Kickback Statute. If there is any type of referral relationship between the physician and the ALF, it could be a risk for fraud and abuse charges.

Here's a link to a blog from a law firm that does a good job explaining some of the risks and laws in a somewhat easy to read format. (Easier to read than the actual legal statute anyhow!)
