Prompt Pay and Worker's Comp

Question: Do the prompt pay laws apply to worker's comp claims? These take so long to receive payment on, I'm just wondering what I can do to get payment sooner.

Answer: Whether or not prompt pay laws apply to the worker's compensation (WC) claims you deal with depends on your state. Some states do not apply prompt pay laws to WC claims. Others do, however. Michigan, for example, allows a practice to charge a 3 percent late fee -- 3 percent of the WC allowed amount -- if the claim is not either denied or paid within 30 days for clean claims (non-denied and non-disputed).

Pointer: You may also be able to file a complaint with the labor review board or another state entity if you are finding that your WC claims payment is frequently delayed. You should also consider having a standard letter that you can send to WC, auto, or other insurance companies that let's them know you think they may be in violation of prompt pay regulations within your state.
