As stated in Chapter 2 of our Compliance studies, under Responding to detected offenses and developing corrective action initiatives, type of issues, bullet 2- states that medical records are to be signed/completed within 90 days. I can not find any reference to this statement.
I have a provider who has submitted claims to me to bill, and I have discovered that they were completed up until the signature on the date of treatment, but not signed. He just now signed them just shy of the timely filing deadline of 365 days. I have notified him that I can not submit these claims due to the notes not being completed in a timely manner. He wasn't happy about that.
I need to send him actual rules/laws. He also states that guidelines are not laws. Can someone please assist me with obtaining the actual laws that clearly state the 90 days that were indicated in our studies? And/or any additional rules/laws that will help me in this matter.
