Hello,
Our Ophthalmology practice utilizes the PA on sx days by having him perform lasers (yags/slts). We are getting paid, and at 85% profee/100% facility as expected.
His supervising MD is in Sx all day. I do not consider this direct supervision as outlined by CMS guidelines.
Am I wrong? Can I bill his lasers as incident- to since the MD is "15 feet away and not in sx the entire time"??

The PA is performing surgical procedures without the presence of the physician? That raises a number of questions, but I would generally agree with you that this would not qualify as an 'incident to' situation.

But regardless, you can't bill 'incident to' in a facility location, only in an office.
