Are you legally able to collect the 20% from a patient that has Medicare and no secondary?

Yes, you are actually legally required to collect it. This is the patient's cost share and while they are not required to have secondary insurance, they are required to pay their portion of the cost share (deductible and co-insurance).

I guess I should have also said can we collect at the time the pt comes in for the appt. before it has been billed to Medicare. Sorry for the incomplete question.
