I am hoping there is somebody out there who can help me with this....

My doctor performed an excisional biopsy of deep cervical nodes and in the process removed some fat pad with them. Can he code 38520 (excision of lymph node(s); open, deep cervical node(s) with excision of scalene fat pad) when only a portion of the fat pad has been removed, or should he use code 38510 which would represent the deep cervical nodes?
