Can I use 99238 for a patient who was admitted and left against medical advise? Or would this be considered observation?

Assuming that the order to admit the patient was for inpatient, not observation, and also assuming your physician was either not the one who admitted the patient if he left the same day, or this is a subsequent date after admission - then yes, if there is documentaion of his discharge services.
