when a patient was critical care with 45 mins then passed away the discharge summary is now documented with 35 minutes in addition to the cc time; can this be coded as both 99291 & 99239 or only 99239?

Stick with the critical care

I would bill the critical care code only. It pays better and you will not be allowed both if it is a Medicare claim. Good luck!
