Can we bill critical care and 99238 discharge? The patient has expired.

If the patient was admitted to the hospital and was not an ED patient on the same day then, yes. However, if the patient was never admitted into the hospital and received all the critical care treatment in the ED only, then no you cannot. The critical care charges would be all that you would code. Did the patient ever leave the ED during treatment, or transferred to ICU for concurrent treatment?
