I am being told that if a Medicare patient wants to come to our ASC to have a procedure that is Non ASC approved, but is covered in an office, hospital, or other approved by Medicare, we are not legally allowed to perform the surgery even if the patient signs an ABN...

Can anyone please

a) Confirm this information
and
b) Provide a federal resource that I can take to my employer
