Can we bill modifier AS for ortho techs assisting in surgery?

You can bill this modifier for assisting if your payer credentials and recognizes ortho techs as a provider. However, the problem you run into with these provider types is that most payers do not recognize them, and for services provided in an OR in a facility, since you cannot bill 'incident to' and cannot bill the services under the supervising provider, there is effectively no way to bill for their services.
 
I say no. The description of -AS is PHYSICIAN ASSISTANT, NURSE PRACTITIONER or CLINICAL NURSE SPECIALIST services for assistant at surgery. Since your tech is none of those 3, it should not be used.
