The patient lost weight after being in the weight loss program and her BMI at the time of surgery was 34. I'm trying to find out if we can use her BMI of 39 from the time that she entered the program. Otherwise, this won't be paid by Medicare. Does anyone have any info?

Nope...sounds like the weight loss program was working, and that surgical intervention wasn't medically necessary. Did you get an ABN? If not, you're probably up a creek without a paddle...sorry. :(
