Can you bill a laporoscopy gastric bypass 43644 with a lap hiatal hernia which i use the unlisted code as 43289.

Yes you can bill the repair, but it isn't unlisted; it's a 43281 w/o mesh or a 43282 with mesh. Usually it's without in this situation.
