My office is working with a vendor to support our behavioral health collaborative care model. The vendor employs the LCSW and psychiatrists to help support the management of my primary care patients. That includes screenings for depression, anxiety, etc., assessments, coaching, motivation and review of the patients progress. This is all done via the patient’s mobile phone app. When appropriate the vendors team will communicate with the primary care office with decision support. And when the # of minutes and intensity reach the thresholds for billable BH CoCM services, they will provide that documentation and the appropriate codes to the primary care provider to bill the insurance carrier.

I am being told by my biller that this would fall under “incident-to” services and could not be billed unless the my practice employed the LCSW and Psychiatrist. Is this true?
