There is no place-of-service restriction on 90839-90840. The question would be if the "therapist" were eligible to bill in a hospital setting. Quite a while ago, I had an issue where an LCSW (Licensed Clinical Social Worker) was going to go see their own patient in a facility setting. However, because the facility was required to provide "social work care" as part of their services, the LCSW would not have been reimbursed (even though an LCSW is not a "social worker" as people think of it, they are a mental health licensed therapist).

I don't bill for ED, so I don't know the answer to the question.

I am unclear as to your question on how it relates to the ED physician - these are separate services.
