Can you use "Time and Co" on New Patient?

Doc sees a new patient and spends 45 of 60 minutes counseling and co-ordinating care. Can time be used to choose the E/M code in this situation? Or do we have to use the 3 key components because it states that you must meet the three key components for new patients?
 
As long as counseling constitutes more than 50% of the time spent with the patient, you may use time to choose the level of visit. Keep in mind that the time must be documented in the notes, as well as a detailed decription of what was discussed. If you don't have these things, then you must revert back to the 3 key components.
