i have a patient who has come in for hemorrhoids and upon office visit... we ended up doing an anascopy on her.. can i still code for office visit with 25 as my added modifier to office visit and then add the code 46600 also? is that legal?

Yes, I have billed both. As long as this was not a planned anoscopy and your doctor's dictation can stand alone as a billable office visit, then I would bill both codes out.
