Coding Fracture after surgery

I am needing some advise on coding an OV for a patient. He had surgery to repair a navicular fracture. Patient did not follow post surgical directions and now has a non union fracture of the same bone that was repaired during surgery. I am needing to know if this would still be considered global or if we can bill since the patient was progressing well and now has the issue with the fracture again.
 
Global Surgery Fact Sheet

Two things I have read on this sheet from Medicare that states what services are NOT included in the global surgery payment?

1) Visits unrelated to the diagnosis for which the surgical procedure is performed, unless the visits occur due to complications of the surgery.

2) Treatment for the underlying condition or an added course of treatment which is not part of normal recovery from surgery.
