Per the following link http://www.dol.gov/ebsa/faqs/faq-aca12.html (see Question 7)
a patient who is considered high risk due to personal or family history should be considered for the screening benefit under the Affordable Care Act. We continue to have issues with various payers not recognizing the personal/family history codes as preventitive. HAs anyone else had this issue and how have you handled? This is the first time I believe that I have seen this in writing.
 
Yes- we use the 33 if the primary icd-9 is V76.51 , V12.72, etc ( any of the history codes)
