I am confused about the description for this code. Why wouldn't it say something like "myocardial infarction occurring over 28 days ago"?
In what circumstance would you NOT use this code if the patient had a documented MI longer than 28 days ago?

That code is for Old MI, so as long as the MI was longer than 28 days ago, you will be able to use it. If the MI was between now and 28 days, then other MI codes would apply.
 
Per the ICD-10 guidelines:

For encounters after the 4 week time frame and the patient is still receiving care related to the myocardial infarction, the appropriate aftercare code should be assigned, rather than a code from category I21. For old or healed myocardial infarctions not requiring further care, code I25.2, Old myocardial infarction, may be assigned.
