Does the new patient rule(have not rec'd care from the phy or any other phy in the same practice/specialty in the previous three years) apply when 99201-99215 are used in the outpatient hospital setting(er holding or observation)?

ex: when our hospitalists is asked to see a patient in observation but another physician is the principal physician of record.
 
Yes.

New and established are not based on the setting. So the rules apply no matter where the service takes place.
