Could a provider bill for a New Patient who is being evaluated to be placed into an Assisting Living Facility (99324 to 99328) with a date of service of when the patient was evaluated and approved for admission/move in date, even if the patient will not be moving in until the following week? The POS where services rendered is 33.

You can't bill "in anticipation" of an assisted living visit. Bill the face to face service based on the POS at the time of service. You cannot bill the initial assisted living service if they are not yet in that facility, but you may be able to bill some other E&M visit, depending on the nature of the visit. Or, the provider can wait till the patient arrives at the facility and then see them at that time.
