Wiki E/M and Fetal Echocardiogram

I have a question that I need your expertise opinion.
I am doing a chart review for a pediatric cardiologist. He is an Echocardiogram doctor. Patient is referred to see him for having an echocardiogram done due to family history of heart disease. He spent 20 minutes with the patient, 50% of the time was dedicated to patient management and counseling. And he gave a consult code 99242/25 and echo testing codes.

My understanding is that :
?The consult code has to be distinct and significant, separately identifiable E/M that the consult code cannot be billed.
?The consult is done after the Echocardiogram
?The only think we can go if it is billed by using the time base for the time spent with the patient. ( I think we cannot use the E/M template to look at the HPI, Exam and MDM)
My question:
Can the E/M template be used for the fetus. (personally I don?t think so) The fetus is still inside the body of the patient. The fetus is not the patient. That is why the echo was done.
What do you think ? Can anybody give me some insight?
