A lot of the time a physician will discuss a patient who came into the ER with another physician such as the orthopedist, internist, current physician, physician from another hospital for transfer, etc... Can I give the physician any points in the Data section of MDM for this?

Yes discussion of case or consult with other physicians provides 2 data complexity points. If labs are discussed with performing physician this will statisfy 1 data complexity point.
