Yes it is coded based on time, so basically if I have the medical necessity and even though less than 15 mins its ok to bill 99202.

You may code based on EITHER total provider time the date of encounter OR medical decision making - whichever works in your favor. So if time is 14 minutes and you have minimal problem, minimal/no data and minimal risk, 99202 is appropriate. If time is 14 minutes and you have 2 of 3 of low problem, limited data, and low risk, 99203 is correct.

99202 would be appropriate based on MDM, too.
