E/M question coding outpatient medication telepsych. If you bill 999214 on a patient that requires at least 2 of the 3 components but only spending 15 mins. can you still use the 99214 E/M code or should 99213 be used.

If you are using MDM to select your level of service, you do not need to follow the time thresholds. When you use Time as your based in selecting your E/M, then you should adhere to the time . If 15 minutes is all , then it's a 99212.

Ok we have been billing 99213 but our company feels that with some patients we can bill 99214 but I just want to make sure not to get a Medicare audit. But if there is not medication changes in the patient and its just a phone medication check for refills it should be 99213 correct?
 
What do you mean by phone medication check for refills? Is this followed by the day of the encounter or just a phone call for refills and no office visit?
A little tidbits from a webcast that I have attended was to always put the total time, so that the coders can use it if the chosen MDM by the provider does not support it.
