Wiki EHR Inadvertent Inpt Order when notes clearly show intent for observation

Is there any ethical way to rebill an inpt claim as a corrected observation claim. The provider intended observation status per notes in medical record, but ordered inpt instead. Claim has been denied as not med nec (severity of illness and intensity of service did not warrant inpatient status). Provider confirmed that his intent was for observation. How should we procede? Can we do a corrected claim without that timed observation order? Can we change the order from inpt to observation due to clerical mistake and rebill? Should we get a clarification addendum to the medical record and use it as we appeal up to the ALJ level and request obs pmt when ALJ denies inpt for medical necessity?
