Can a Dr who does office based surgery submit claims as a facility? and where can I find this information to back it up?

Thank you in advanced for any help:)
 
It is my understanding that you cannot bill as a facility unless the facility owns you. We bill as an Article 28 Facility and we are all under the same Tax ID number, all my providers work for the Hospital and the Hospital owns all our offices, so they get the technical component for each visit.
