If my doctor is a patient's attending in the hospital and another doctor does the patient's surgery, once discharged from the hospital, the patient is instructed to follow-up with the attending doc, does the follow-up day rule still apply? Can the attending doc bill the patient for the office visit?

if the follow up is a medical follow up and not a surgical follow up it will be good to go. The surgeon must be the provider to perform the surgical follow up. If the surgeon wants to transfer the surgical follow up to the attending, this must be a transfer of care in writing and then your provider would bill the surgical follow up using the surgical CPT code with a 55 modifier.
