Wiki H & P done sameday as Ambulatory surgery

My surgeon does and H & P for emergency appendectomy and we are not allowed to bill for it, as it's observation status....how can we get paid for this?
 
If it's observation then use inital observation 99218-99220. If not we use the office visits, new patient 99201-99205 with 57 modifier if new pt. Otherwise we use Est patient office visit

H&P for appendectomy...hopsital says can't bill for this.

How do we get paid for the admiit as, the hospital is telling me, because it's ambulatory (sameday surgery) we can't bll for the H & P?
