Can anyone provide me a link to where it says that psychotherapy notes should be kept seperate from the rest of record? I know its a HIPPA thing, but can't find it on the site.
 
Under the final privacy rule, known as the Health Information Portability and Accountability Act (HIPAA), psychotherapy notes are defined as an official record created for use by the mental health professional in "documenting or analyzing the contents of conversation during a private counseling session ... separated from the rest of the individual's medical record."

Provider's Psychotherapy Notes
You do not have the right to access a provider's psychotherapy notes. Psychotherapy notes are notes taken by a mental health professional during a conversation with the patient and kept separate from the patient's medical and billing records. The Privacy Rule also does not permit the provider to make most disclosures of psychotherapy notes about you without your authorization.
 
A few questions
1) What is considered the medical record for this info's purposes? Is it the chart that is used for the patient in the clinic? ( We are part of a huge organization with multiple specialties, so they might be a psych chart, maybe a cardiology, ortho, etc)

2) We are on EMR. Providers document their visits and there is special security that limited people have access to. Are you saying that there should be 2 charts for each patient basically? One with psychotherapy notes in it and one chart with all other psych info?
Or would my chart for the entire psych clinic be considered seperate because it is not accessible with the regular medical charts that we would use for them in FP, ortho, etc???
