It depends on your state. We keep EOB on file for 7 years and any WC forever. Keeping the WC is just how we do it. I would check with your state to see what their requirements are. I would keep them at least 5 - 7 years either way unless you are required to keep them longer. :)

I did looked into my state laws but they all are taking about medical records and I think EOB is consider fiancial record so wasn't sure if same rules apply in keeping EOBs on file. Also with most of insurance companies we can always go back and get copy of the EOB on thier website.

You also need to be sure to check with your malpractice insurance carrier. In some cases, they have different rules for records that may exceed any jurisdictional regulation.
