Wiki "Incident to" Employment Requirements for NY

We are a large Hospital System in New York. The MD provider is in an offsite clinic (POS 11). Can the NP bill incident to if the NP is employed by the Hospital?

Any thoughts are appreciated. Thanks!

Are the NP and the MD both employed by the same hospital? If so, then you may be able to if the other requirements are met. But if the MD is not employed by the same organization, then no. One of the requirements for 'incident to' billing is that the provider performing the services must be an employee of the provider billing for that service. A provider may not bill for services of another provider for whom they are not responsible for the costs.
