Wiki Lap Band Adjustment (S2083) as Incident To?

Hi,
I have a provider who is wondering if lap band adjustments can be billed as Incident To if the MD includes it in the original plan of care? My inclination was to say it's not applicable, but I'm getting some push back. Has anyone billed this, and if so, how do you ensure the documentation is compliant?
