If a surgeon does a lap chole and a lap umbilical hernia repair (the hernia repair not being an expected procedure) which causes an additional 45 mins over the usual time of the procedure, would you be able to code them separately with a mod?

They should not be NCCI edits, so -59 or -X___ may not be necessary. You should code for all procedures performed (even if not expected) unless they are bundled.
