laparoscopic gastric banding with hiatel hernia repair

I've seen this scenario addressed before but the codes given were for open hiatel hernia repair. When doc does a laparoscopic gastric banding for morbid obesity (43770) and repairs a hiatel hernia at the same time (laparoscopically) without a fundoplasty, would you bill the hernia repair and if so what code would you report? The open hiatel hernia repair code is 39502:confused:
