If a patient was seen for a pre-op exam and the MDM is moderate but the provider has a time statement of 25 minutes - would you bill based on the MDM or the BBOT statement - (would you lower the e/m because of the time statement)?

No. You can bill whichever is more advantageous to the provider - time or MDM.
