Does Medicare allow for an assistant surgeon in an office setting and if so is it limited to an MD for assistant?
 
Whether or not the code allows an assist the the key question here. If the code does, then the assist can be MD/DO (mod -80), or PA/NP/CNS (mod -AS).
Very few office settings have the capability to perform the types of procedures that allow for a surgical assist. If your office does, and there is an assist, you may bill for it.
