We are an ophthalmology practice. Prior to cataract surgery, our patients are provided with a "surgery kit" that includes necessary eye shield, artificial tears etc. Until the new pharm rules/regs went into effect 01/09, we have rec'd these items at no cost from our drug reps and therefore provided them to our patients at no cost. Now however we are having to pay a minimal amount for these items and the docs want to recoup this from our patients.
I feel we will need to bill Medicare using CPT 99070 and have the patient sign an NEMB form. Would you agree? Also, is our charge limited to our cost of the items w/ no mark up allowed?
