If a physician meets with a nursing home resident's family in his office outside of the nursing home to discuss end of life issues, can this billed as a time based visit E&M?

I would say okay to bill. I would ask the doc to document time spent with family as well as details of the discussion. Established pt office visit states "counseling and/or coordination of care with other providers or agencies are provided consistent with the nature of the problem and the patient's and /or family's needs."
