Wiki Modifier 55 After 44950

QUESTION: Pt had 44950 (appendectomy) on 3/30/7 by surgeon-then had follow up visit on 4/9/7, by different surgeon. They've coded this follow up as 44950 with a 55 modifier. Shouldn't this be a E&M code with 55 modifier instead? Payor has denied as "only one appendectomy per lifetime".
