To the best of my knowledge there are some cases where modifier 76 can be used with a major surgical procedure,but it usually applies to procedures that cannot be quantity billed and it definitely cannot be used with if the same procedure was repeated on a different date.
In my case the same procedure was performed a couple of weeks apart from each other and modifier 76 was applied. I know that it is incorrect and the only documentation that supports my claim is not from NY state ,but my supervisior insists on me getting this documentation that pertains to NY state.
Can someone be kind enough to provide me with a link to modifier 76 factsheet that is for NY state?
