Here is my situation. A patient comes in for their scheduled infusion for their RheumatoidArthritis. They see the nurse practitioner for a follow up on their gout while they are here. Would you use modifier XP on either encounter? The infusion is billed under the physician and the follow up is billed incident to under the nurse practitioner and the same physician. Please help settle this argument in my office.
 
No, I would use modifier 25 on the follow-up visit. The E&M service is the column 2 code in NCCI so that is the service that should have the modifier. Modifier XP would not be correct on an E&M code because that service is not a procedure.
