I have a dilemma and am looking for resources to present to the providers I bill for, the rule to bill New E/M codes as I understand it is that you can bill new E/M if patient is not seen for last three years, I have a provider that bills new E/M if patient has new insurance (after patient was self pay) and another provider who wants to bill a new E/M for each new injury (Ortho Surgeon):confused:

By CPT definition, a new patient is "one who has not received any professional services from the physician, or another physician of the same specialty who belongs to the same group practice, within the past three years."

Medicare= Interpret the phrase “new patient” to mean a patient who has not received any professional services, i.e., E/M service or other face-to-face service (e.g., surgical procedure) from the physician or physician group practice (same physician specialty) within the previous 3 years.
